New Wage & Hour Regulation Update
The United States Department of Labor recently released proposed final regulations revising the guidelines for white collar exemption status. These regulations mark the first substantive change to the wage and hour regulations since 1978. Due to take effect on August 23, 2004, the new regulations should clarify the exemption tests and provide greater protections for employers. Issued after a year-long public comment period featuring vehement criticism from labor groups and Democratic lawmakers, the new regulations should provide clearer guidance to employers and decrease litigation.
